1. Acceptance and eligibility
To use AirQuote, you must be at least 18 years old, capable of forming a binding contract, and not barred from using the Service under US law or the laws of your jurisdiction. By using AirQuote, you represent and warrant that you meet these requirements.
If you are using the Service on behalf of a business, you represent that you have the authority to bind that business to these Terms, and "you" in these Terms refers to that business.
2. Account registration and security
You must provide accurate, complete information when creating an account, and you must keep that information current. You are responsible for safeguarding your password and for all activity that occurs under your account. Notify us promptly at hello@airquote.co if you suspect unauthorized access.
You are responsible for the lawful collection, use, and storage of the customer and job information you enter into AirQuote. When you enter customer information into the Service, you are acting as the controller of that information and AirQuote is your processor. You are responsible for having a lawful basis for processing your customers' data and for honoring your customers' privacy rights.
3. Subscriptions, billing, and pricing
AirQuote offers a paid Pro plan at a published monthly or annual price (currently $12 USD per month, or an annual rate; check the pricing page for current pricing). Subscriptions automatically renew at the end of each billing period at the then-current price unless you cancel before the renewal date.
Billing is processed by Stripe. By providing payment information, you authorize us and Stripe to charge the applicable fees and any taxes to your payment method on a recurring basis.
We may change prices at any time. If we change the price of a subscription, the change will take effect at your next renewal, and we will give you at least 30 days' notice by email before the new price applies.
You are responsible for any taxes associated with your subscription that are not collected through Stripe.
4. Free trial
We may offer a free trial period for the Pro plan. The trial gives you access to Pro features for a limited time at no cost. We may require a payment method to start the trial. If you do not cancel before the trial ends, your subscription will begin and your payment method will be charged.
5. Cancellation and refunds
You may cancel your subscription at any time through your account settings or the Stripe customer portal. Cancellation takes effect at the end of your current billing period; you will continue to have access to paid features until then.
Except where required by law, fees already paid are non-refundable. We will consider refund requests in good faith for genuine product failures or billing errors; email hello@airquote.co within 14 days of the charge to request a review.
6. Acceptable use
When using AirQuote, you agree not to:
- Use the Service for any unlawful purpose, or to violate any law or regulation.
- Send spam or unsolicited communications, including through AirQuote's email features.
- Use AirQuote to generate or distribute fraudulent quotes, contracts, or invoices.
- Misrepresent your identity, business, or licensing status to customers in materials generated through the Service.
- Reverse engineer, decompile, or attempt to extract the source code of the Service, except as expressly permitted by law.
- Use automated means to scrape, harvest, or access the Service beyond rate limits applied to your account.
- Interfere with the security, integrity, or performance of the Service or attempt to gain unauthorized access.
- Use AirQuote to process information for which you do not have a lawful basis, or to handle categories of data we have asked you not to enter into the Service (such as sensitive personal data, payment card numbers, government identifiers, or protected health information).
7. Your content
You retain all rights to the information, business details, customer details, quotes, contracts, invoices, and other content you create or upload through the Service ("Your Content"). You grant AirQuote a limited, worldwide, non-exclusive, royalty-free license to host, store, process, and display Your Content solely as needed to provide the Service to you and to comply with these Terms and our Privacy Policy.
You represent that you have all rights necessary to upload and process Your Content through AirQuote, and that doing so does not violate the rights of any third party.
8. AI-generated content
AirQuote offers features that use artificial intelligence to draft quotes, contracts, voice transcriptions, and other content based on inputs you provide ("AI Output"). You acknowledge and agree to the following.
- AI Output is a draft, not a final product. AI models can produce inaccurate, incomplete, or fabricated information. You are solely responsible for reviewing, verifying, and editing all AI Output before sending it to a customer, signing it, relying on it, or treating it as authoritative.
- AI-generated contracts are not legal advice. AirQuote is not a law firm and does not provide legal services. Any contract or contract-like document generated by AirQuote is a starting template only. Before signing or using any contract in a binding transaction, you should have it reviewed by a qualified attorney in your jurisdiction. Use of AI-generated contracts is at your own risk.
- AI-generated pricing is not financial advice. Quote suggestions, rate suggestions, and price-check outputs are estimates based on patterns in the underlying model and do not guarantee profitability, market competitiveness, or compliance with any pricing law.
- AI inputs are sent to our AI provider. The inputs you provide to AI features are processed by Anthropic in accordance with their data handling practices. We do not opt in to model training, and Anthropic does not use API inputs to train its models by default. See the Privacy Policy for details.
- You own AI Output you generate. As between you and AirQuote, you own the AI Output produced by your inputs, subject to your compliance with these Terms and any underlying rights of third parties. AirQuote does not claim ownership of your AI Output.
AirQuote's AI features are productivity tools that draft content for you to review and edit. They are not high-risk decision systems and are not used to make automated consequential decisions about consumers within the meaning of the Colorado AI Act or similar statutes.
9. Intellectual property
The Service, including its software, design, logos, and content created by AirQuote (excluding Your Content and AI Output) is owned by AirQuote and protected by US and international intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose, subject to these Terms.
You may not copy, modify, distribute, sell, or lease any part of the Service or its underlying software, except as expressly permitted by these Terms or applicable law.
10. Third-party services
The Service integrates with third-party services, including Supabase (database), Netlify (hosting), Stripe (payments), Anthropic (AI), and Zoho (email). These services are operated by their respective providers under their own terms and privacy policies. AirQuote is not responsible for the acts or omissions of any third-party service, and your use of these services through AirQuote is subject to those providers' terms.
11. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, statutory, or otherwise.
To the maximum extent permitted by law, AirQuote disclaims all warranties, including the implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted operation. We do not warrant that the Service will meet your requirements, that AI Output will be accurate or complete, that the Service will be uninterrupted or error-free, or that defects will be corrected.
Without limiting the above, AirQuote makes no warranty that any quote, contract, invoice, or other deliverable generated through the Service will be legally enforceable, financially profitable, or compliant with the laws of any jurisdiction. You are responsible for the use you make of the Service.
12. Limitation of liability
To the maximum extent permitted by law, AirQuote and its officers, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, business opportunity, or substitute goods or services, arising out of or related to your use of the Service, even if AirQuote has been advised of the possibility of such damages.
To the maximum extent permitted by law, AirQuote's total cumulative liability for any claim arising out of or related to these Terms or the Service, regardless of the form of action, is limited to the greater of (a) the amount you paid AirQuote in the 12 months preceding the event giving rise to the claim, or (b) one hundred United States dollars ($100).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. To the extent those laws apply, the disclaimers and limitations above apply only to the maximum extent permitted in your jurisdiction.
13. Indemnification
You agree to defend, indemnify, and hold harmless AirQuote and its officers, employees, contractors, and affiliates from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Service, (b) Your Content, (c) your violation of these Terms, (d) your violation of any law or the rights of any third party, including any of your customers, or (e) any quote, contract, invoice, or other deliverable you create through the Service and provide to a third party.
14. Termination
You may terminate your account at any time through the Service or by emailing hello@airquote.co.
We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms, presented a risk to the Service or other users, or for any other reason permitted by law. Where reasonably possible, we will give you notice and an opportunity to cure.
Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination will survive (including Sections 7 through 17).
15. Dispute resolution and governing law
These Terms and any dispute arising out of or related to these Terms or the Service are governed by the laws of the State of Colorado, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
You and AirQuote agree that any dispute arising out of or related to these Terms or the Service that cannot be resolved informally will be brought exclusively in the state or federal courts located in Denver County, Colorado, and you and AirQuote consent to the personal jurisdiction of those courts.
Before filing any formal claim, you agree to first contact us at hello@airquote.co and give us 30 days to attempt to resolve the dispute informally.
16. Changes to these Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. If the changes are material, we will provide notice through the Service or by email before the changes take effect. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of them.
17. Miscellaneous
- Entire agreement. These Terms, together with the Privacy Policy and any other policies referenced in them, are the entire agreement between you and AirQuote regarding the Service.
- Severability. If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect.
- No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
- Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
- Notices. We may give notices through the Service, by email to the address associated with your account, or by posting to our website.
- Force majeure. AirQuote is not liable for any delay or failure to perform caused by events beyond our reasonable control.
